PEI Martial Arts Academy Inc. (“PEI MMA,” “we,” “us,” or “our”) respects the privacy of our members, families, program participants, website visitors, and individuals who contact us.

This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information in connection with our martial arts programs, youth and childcare programs, camps, events, websites, online advertising, registration systems, and other services.

We handle personal information in accordance with applicable Canadian privacy requirements, including the Personal Information Protection and Electronic Documents Act (PIPEDA) where applicable.

The information we collect depends on your relationship with PEI MMA and the services or programs you use.

  • Photos, videos, or other media where appropriate consent has been obtained;

  • Website and technical information such as browser information, device information, cookies, and website usage data.

We seek to collect only information reasonably necessary for the purposes identified at or before the time of collection.

2. How We Collect Information

We may collect personal information directly from you through:

  • Program and membership registrations;

  • Waivers, consent forms, and program forms;

  • Our website;

  • Email, telephone, and in-person communications;

  • Social media and online advertising inquiry forms, including Meta/Facebook and Instagram lead forms;

  • Surveys and feedback forms;

  • Camp, After-School, youth program, and event registrations; and

  • Third-party platforms that we use to operate our programs and services.

Where appropriate, information about a child or youth is collected from or with the involvement of their parent or legal guardian.

3. Why We Use Personal Information

We may use personal information to:

  • Register and administer memberships, classes, camps, After-School programs, youth programs, events, and other services;

  • Determine program eligibility and appropriate placement;

  • Communicate with members, parents, guardians, and participants about scheduling, program changes, attendance, payments, emergencies, and other operational matters;

  • Support the health, safety, accessibility, and well-being of participants;

  • Process payments and maintain appropriate financial and business records;

  • Manage waivers, consents, emergency contacts, and program documentation;

  • Provide customer service and respond to concerns;

  • Improve our programs, services, website, and operations;

  • Maintain the security and integrity of our facilities, systems, and services;

  • Meet legal, regulatory, insurance, accounting, and safety requirements; and

  • Send promotional or informational communications where permitted by law and where the appropriate consent or other legal basis exists.

We will not use personal information for a materially different purpose without obtaining additional consent where required.

4. Children and Youth

Protecting children's privacy is particularly important to PEI MMA.

Our websites, advertising forms, and general inquiry forms are intended to be completed by parents, guardians, or other responsible adults where information concerning a child is involved.

For children who cannot meaningfully provide consent themselves, we obtain consent from a parent or guardian as appropriate. The Office of the Privacy Commissioner of Canada generally takes the position that this includes children under 13, except in exceptional circumstances.

We may collect information about children when reasonably necessary to provide programs safely and effectively. Depending on the program, this can include registration information, emergency contacts, relevant health or allergy information, authorized pickup information, attendance, and other information necessary for participation.

We do not knowingly collect children's personal information through general advertising or inquiry forms directly from children.

5. Consent

We obtain consent for the collection, use, and disclosure of personal information where required.

The form of consent may depend on the circumstances and the sensitivity of the information. More sensitive information may require more explicit consent.

Individuals may withdraw their consent to certain uses of their information, subject to legal, contractual, safety, or operational requirements. Withdrawal of consent may affect our ability to provide certain programs or services.

Canadian privacy guidance emphasizes that consent should be meaningful: people should reasonably understand what information is being collected, why it is being collected, and the consequences of providing it.

Providing information to inquire about a PEI MMA program does not automatically mean that you have agreed to receive unrelated ongoing marketing communications.

We may contact you to respond to your inquiry and provide information reasonably connected with the program or service you asked about.

Promotional emails, text messages, and other commercial electronic communications are managed in accordance with applicable Canadian anti-spam requirements. Where required, we obtain consent and provide appropriate identification and unsubscribe options.

7. Service Providers and Third-Party Platforms

PEI MMA uses third-party service providers and technology platforms to help operate our business and programs.

  • Membership and program registration;

  • Payment processing;

  • Online forms;

  • Data storage and cloud services; and

For example, information may be processed through platforms used for membership management or through Meta when someone submits a Facebook or Instagram lead form.

We may provide these service providers with personal information when reasonably necessary for them to perform services on our behalf.

PEI MMA remains responsible for personal information under its control, including information transferred to third parties for processing.

Some service providers may process or store information outside Prince Edward Island or outside Canada. When information is processed in another jurisdiction, it may be subject to the laws of that jurisdiction.

We do not sell personal information.

We may disclose personal information:

  • To service providers acting on our behalf;

  • Where necessary to deliver a program or service;

  • With consent;

  • Where necessary to protect the health or safety of a participant or another person;

  • To insurers, professional advisers, or authorities where reasonably necessary; or

  • Where required or permitted by law.

We limit disclosure to what is reasonably necessary for the applicable purpose.

9. Safeguarding Personal Information

We use reasonable administrative, technical, and physical safeguards appropriate to the sensitivity of the information in our possession or control.

These measures may include restricting access to personal information to individuals who require it for legitimate business or program purposes and using appropriate security measures for electronic records and systems.

No method of electronic transmission or storage is completely secure, but we take reasonable measures to protect personal information against unauthorized access, use, disclosure, loss, or modification.

PIPEDA requires safeguards appropriate to the sensitivity of the information being protected.

10. Retention of Personal Information

We retain personal information only for as long as reasonably necessary to fulfill the purposes for which it was collected and to meet applicable legal, accounting, insurance, safety, dispute-resolution, and business requirements.

Different types of records may therefore have different retention periods.

When personal information is no longer reasonably required, we take appropriate steps to securely destroy, delete, or anonymize it, subject to applicable requirements.

This reflects PIPEDA's principle that organizations should retain personal information only as long as necessary for the identified purposes.

PEI MMA may photograph or record classes, camps, programs, events, or other activities.

Where consent is required, appropriate photo/video or media consent will be obtained. Declining optional promotional media consent will not prevent participation in a program unless recording is reasonably necessary for a separate stated purpose.

You may contact us to request access to personal information PEI MMA holds about you or to request correction of inaccurate or incomplete information.

We may need to verify your identity before responding.

Certain legal exceptions may limit access in some circumstances.

PIPEDA provides individuals with rights concerning access to personal information held by organizations and the ability to challenge its accuracy and completeness.
